海外バイヤーからの虚偽販売に関する指摘への対応について

平素は格別のご高配を賜り、厚く御礼申し上げます。
この度、2024年11月開催の第5回ジャパンパールフェアにておいて、ある海外バイヤー様より5月に行った組合員との取引において虚偽販売によるトラブルが発生しているとの相談が事務局に入りました。そこで、当組合定款第８条二のト所定の「真珠の輸出に関する苦情の解決及び紛争の仲裁」を行うべく、理事数名が両者から事情を複数回にわたって伺い、公平に調査を行いましたが、残念ながら当該組合員から納得のいく回答が得られませんでした。また、この案件以外にも、当該組合員から同様の被害を被ったことがあるという他の複数の組合員の申出もあり、万一、これらの苦情や申出が事実であれば、当該組合員の除名を総会にお諮りすることも視野に慎重に事実関係の調査に努めていたところ、突然、当該組合員より、健康上の理由により脱退届が提出されました。
当組合としては、調査途中で脱退申出がなされ、事実確認への協力が得られなかったことを大変遺憾に思いますが、まずはこうした事案があったことを皆様にご報告申し上げます。一般に、虚偽販売は絶対にあってはならないことであり、こうしたことは組合のみならず日本の真珠産業全体の信頼を失墜させかねません。今回は事実調査が未遂の状況にはございますが、今後ともに、当組合は虚偽販売を許容しないポリシーの下、組合運営を行っていく所存です。
当組合では、加工処理に関する情報開示ルール（資料参照）を徹底し、情報開示が必須の項目については必ず明示することを義務付けており、組合員の皆様はインボイスに必ず商品名と情報開示事項に該当する項目を記載するようにお願い致します。
なお当該組合員と当組合とは、退会手続き終了後は今後一切関わりがないことをご承知おきください。

Regarding the Response to indications from overseas buyers regarding false sales
We sincerely appreciate your continued support and cooperation.
Recently, during the 5th Japan Pearl Fair held in November 2024, the JPEA office received a consultation from an overseas buyer regarding an issue involving alleged false sales in a transaction with a member of our association conducted in May. In accordance with Article 8, Section 2 (ト) of our association’s by Constitution, which provides for “resolution of complaints and arbitration of disputes related to pearl exports,” several board members conducted multiple interviews with both parties to investigate the matter impartially. Unfortunately, we were unable to obtain satisfactory responses from the member in question. Moreover, additional complaints were submitted by multiple other members, claiming they had suffered similar damages caused by the same member. Given the gravity of the situation, and should these claims prove true, we began a careful investigation with the possibility of proposing the expulsion of the said member at a general assembly. However, during this process, the member unexpectedly submitted a resignation letter citing health reasons.
While we regret that the resignation was tendered during our investigation, preventing further cooperation in clarifying the facts, we wish to inform you of the circumstances of this case. False sales are unacceptable under any circumstances, as such actions risk undermining the trust not only in our association but also in Japan’s pearl industry. Although this case remains unresolved due to the incomplete investigation, we are committed to maintaining a strict policy of zero tolerance for false sales as we continue to operate the association.
Our association enforces strict rules on the disclosure of information regarding the processing of pearls (see attached document). Members are required to clearly disclose all mandatory information, ensuring that product names and relevant disclosure items are included on invoices. We kindly remind all members to comply with these requirements.
Please also note that following the completion of the resignation process, our association will have no further relationship with the member in question.
